Position Title: Data Privacy and Retention Officer

Department: SayPro Classified Office / SayPro Marketing Royalty

Reports To: Senior Data Privacy Manager


Position Summary:

The Data Privacy and Retention Officer is responsible for ensuring that SayPro adheres to data minimization principles, protecting user privacy, and complying with all applicable regulations and internal policies. This role involves overseeing data retention practices, ensuring that outdated or unnecessary data is securely disposed of, and maintaining privacy standards under SayPro’s Classified Office and Marketing Royalty divisions. The Data Privacy and Retention Officer ensures that SayPro maintains the highest levels of data protection, transparency, and compliance with privacy laws.


Key Responsibilities:

  1. Data Minimization Oversight:
    • Review and Implement Data Retention Policies: Ensure that all user data collected through SayPro platforms is stored only for the minimum time necessary for business purposes. Review and update the data retention policy regularly.
    • Secure Disposal of Outdated or Unnecessary Data: Collaborate with IT and data management teams to ensure that outdated, irrelevant, or unnecessary user data is securely disposed of, in compliance with SayPro’s data retention policy.
    • Monitor Data Storage Practices: Regularly audit the storage systems to ensure that only necessary data is retained, and unnecessary data is discarded promptly and securely.
  2. User Privacy Protection:
    • Ensure Compliance with Privacy Regulations: Stay updated on the latest privacy regulations (such as GDPR, CCPA, etc.) and ensure SayPro’s practices comply with them, specifically regarding user data collection, processing, and retention.
    • Monitor Privacy Impact Assessments (PIAs): Conduct or review Privacy Impact Assessments for new and ongoing projects within SayPro to ensure data privacy risks are identified and mitigated at the earliest stages.
    • User Data Rights and Requests: Handle and respond to user requests regarding their data rights, including data access, correction, deletion, and portability requests.
    • Train and Educate Staff: Organize training sessions for SayPro employees to ensure they understand privacy policies, data retention guidelines, and the importance of data minimization.
  3. Collaboration with the SayPro Classified Office and Marketing Royalty:
    • Cross-Department Collaboration: Work closely with teams from the SayPro Classified Office and SayPro Marketing Royalty to ensure that data collection and usage practices align with the privacy standards and retention policies.
    • Marketing Data Privacy: Ensure that user data collected for marketing and advertising purposes is done in line with privacy laws and that the necessary consents are obtained from users before processing their data.
    • Internal Audits and Compliance Checks: Participate in internal audits to assess the effectiveness of data privacy and retention practices across departments. Report findings and recommend corrective actions when necessary.
  4. Data Security:
    • Risk Management: Work alongside the IT security team to identify potential data privacy risks and vulnerabilities, ensuring adequate safeguards are in place to protect sensitive data from unauthorized access or breaches.
    • Incident Response: Assist in responding to data breaches or privacy incidents, ensuring that they are reported promptly to the appropriate regulatory authorities and users as required by law.
  5. Documentation and Reporting:
    • Maintain Privacy Records: Maintain comprehensive records of data processing activities, including data retention and disposal practices, to ensure compliance and provide transparency to internal stakeholders and regulatory authorities.
    • Monthly Reports: Prepare and submit monthly reports on SayPro’s data privacy and retention practices, ensuring compliance with SayPro’s internal and external obligations under the SayPro Monthly SCMR-5 and the SayPro Marketing Royalty guidelines.

Qualifications:

  • Education: Bachelor’s degree in Information Technology, Data Privacy, Law, or related field.
  • Certifications: Certified Information Privacy Professional (CIPP), Certified Information Security Manager (CISM), or similar data privacy certification is preferred.
  • Experience:
    • At least 3 years of experience in data privacy, data protection, or compliance roles, preferably in a technology or classified ads environment.
    • Proven experience with privacy regulations such as GDPR, CCPA, or other relevant global privacy laws.
    • Strong knowledge of data retention policies, data minimization, and secure data disposal practices.
    • Experience in conducting data audits and risk assessments.

Skills and Competencies:

  • Analytical Skills: Ability to analyze data processing activities and recommend privacy enhancements or changes to ensure compliance.
  • Communication: Excellent written and verbal communication skills for preparing reports, training staff, and interacting with internal and external stakeholders.
  • Attention to Detail: Strong attention to detail to ensure that data privacy practices are adhered to and that user data is properly handled.
  • Problem-Solving: Ability to identify issues related to data retention and privacy, proposing effective solutions.
  • Collaboration: Ability to work effectively with cross-functional teams, including IT, legal, marketing, and senior management, to promote privacy best practices.

Key Performance Indicators (KPIs):

  1. Compliance Rate: Percentage of SayPro’s processes in full compliance with data privacy regulations.
  2. Data Disposal Efficiency: Percentage of outdated or unnecessary data securely disposed of within the set retention period.
  3. User Request Response Time: Average time taken to respond to and resolve user data privacy requests.
  4. Training Completion Rate: Percentage of SayPro employees completing mandatory privacy and data retention training sessions.
  5. Audit Success Rate: Results of internal audits regarding data retention and privacy practices, with minimal non-compliance issues.
